Please read these Terms of Service (“Terms”) carefully before using the SwingLab website and applications operated by HN ENGINEERING SERVICES LLC (“us”, “we”, or “our”).
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. AI Output Disclaimer
Our services utilize Artificial Intelligence (AI) to generate content, insights, and recommendations — including swing metrics, scores, annotated videos and coaching suggestions. You acknowledge that AI is not infallible. Output generated by our services may contain errors, inaccuracies, or biases. Swing metrics are estimates derived from 2D video, not laboratory measurements. You are responsible for reviewing and verifying any AI-generated content before relying on it. AI coaching is for informational and training purposes only and is not medical, health, or professional advice — see our AI Coaching Disclaimer. We disclaim all liability for any damages resulting from reliance on AI-generated output.
3. Accounts and Your Content
You are responsible for safeguarding your account credentials and for all activity under your account. You keep ownership of the videos you upload and grant us a limited license to store and process them solely to provide the Service. You confirm you have the right to upload any video you submit and that it does not include third parties who have not consented. Reports are private by default; sharing a report publicly is your choice and your responsibility.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of HN ENGINEERING SERVICES LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
5. Subscriptions and Billing
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. Subscriptions renew automatically until cancelled in Settings → Manage billing; cancellations take effect at the end of the paid period. Payments are processed by Stripe — we do not store your credit card information. The free plan includes 3 analyses per calendar month; failed analyses never count against your quota.
6. Acceptable Use
Don't upload unlawful content, attempt to disrupt the Service, reverse engineer the analysis pipeline, scrape the API, or use automated tools to exceed rate limits. We may suspend accounts that violate these rules.
7. Limitation of Liability
In no event shall HN ENGINEERING SERVICES LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. No Performance Guarantee: we do not guarantee any specific improvement in your golf game from the use of our tools or coaching content.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
